This study examines certain characteristics of legal language which, although it is not peculiar and unique to the law, still distinguish it from ordinary language. In other words, this paper examines how the law uses language to communicate its specific objectives in certain circumstances. It deals with the use of language in legislation, jurisprudence, legal writings and legal logic. Later, it is the correctness or inaccuracy of this particular language in relation to the role of law in a society. This article addresses the question of whether the American founders expected evidence of their own subjective views to guide the future interpretation of the U.S. Constitution. The article examines a range of evidence that has been largely overlooked or misunderstood in previous studies, such as contemporary rules of legal interpretation, the legal use of legislative history, early American public debates, and declarations through state ratification conventions. Based on this evidence, the article concludes that the founders were “original originalists.” This means that they assumed that the interpretation of the Constitution would be guided by the subjective understanding of the ratifyors, if that understanding was consistent and recoverable, and if not by the original public importance of the Constitution.
